Court Finds Reservoir Temps OKby Associated PressKTVB, October 5, 2004 |
BOISE -- The Ninth U-S Circuit Court of Appeals has ruled for the Army Corps of Engineers in a lawsuit over high temperatures at the lower Snake River reservoirs.
The three-judge panel upheld a federal court ruling that the Corps is meeting its legal obligations in operating the four dams.
Conservationists contend the agency is allowing the water temperatures to rise above 68 degrees in the summer, which is dangerous for salmon and steelhead.
Attorney Kristen Boyles of EarthJustice warns the issue of high temperatures won't go away.
She says the environmental groups will continue to press their case in future deliberations over the dam management.
