Judge Michael Simon Denies Request to
Stop Killing of Sea Lions at Bonneville Dam

by Scott Learn
The Oregonian, May 31, 2012

(Mark Harrison photo) Sea lion takes a meal while sea gulls seek the scraps. A U.S. district judge has rejected the Humane Society of the United States' request for an injunction that would immediately stop killing of California sea lions that eat salmon near Bonneville Dam.

Judge Michael H. Simon denied the injunction in a ruling issued Wednesday. The Humane Society's lawsuit against the federal government and the states of Oregon, Washington and Idaho will still proceed.

"The Plaintiffs raise serious questions going to the merits of their complaint," Simon wrote. "The balance of hardships and the public interest, however, do not tip sharply in favor of Plaintiffs, which is required for the issuance of a preliminary injunction when there is not a clear likelihood of success on the merits."
