State Joins Feds
in Salmon Recovery Legal Battle

BOISE -The state of Idaho says the Ninth Circuit Court is wrong about salmon recovery.

The state has joined the federal government in an appeal of a ruling that said the Bush Administration's salmon recovery plan is illegal.

Judge James Redden said the Bush Plan is flawed for several reasons.

First, because it considers dams as a part of the natural environment since they were in place prior to the Endangered Species Act.

Secondly, Redden said the Bush plan simply provides for non-extinction of salmon rather than recovery.

Redden gave the federal government one year to come up with what he called a legal and biologically sound plan.

Thursday's appeal of that ruling was filed with the U.S. District Court.
